PCLOB Recommends Individualized Judicial Approval for Accessing Americans’ Communications under Section 702

Today, as part of its brand-new oversight report on Area 702 of the Foreign Intelligence Security Act (FISA), the majority of the Personal privacy and Civil Liberties Oversight Board (PCLOB) suggested that companies be needed to obtain individualized judicial approval prior to accessing the outcomes of searches of Americans’ interactions, otherwise referred to as “backdoor searches,” except with the consent of that individual or under exigent circumstances.
