Ron DeSantis: OSHA Rule Developed ‘Under the Guise of Emergency Situation Power’

The Occupational Safety and Public Health (OSHA) rule requiring businesses with more than 100 workers to implement vaccine and testing requirements on employees was developed “under the guise of emergency situation power,” Florida Gov. Ron DeSantis (R) said on Thursday, revealing the state’s forthcoming lawsuit challenging the federal mandate.

“The federal government can’t simply unilaterally impose medical policy under the guise of workplace policy. Which is precisely what they’re trying to do here,” DeSantis stated on Thursday.

“This is an effort to insert policy through the administration in such a way that will be tough for a few of these people and private celebrations to withstand,” he continued, asserting the rule is existing under the “guise of emergency power.”

“I believe it’s intriguing that this is being done under the guise of emergency situation power. This was announced two months ago, and it stated, this is an emergency, which this is severe threat,” DeSantis kept in mind:

Then why did it take you two months to provide the rule? And then obviously the guideline does not work up until January, which is practical due to the fact that it’s not going to it’ll reduce labor force disturbances over the holiday season, which we know we’re most likely to see anyways, and after that this would just worsen that.

So this is not consistent with a government of restricted and enumerated powers. There is no general cops power. There’s no power to mandate on the American people from the federal government. People will often point out about state mandates and how those have been enforced through the years. And have the constitutionality has actually been maintained states clearly have a basic cops power, whatever the knowledge of a specific mandate is, is much different when the federal government is imposing that on 10s of millions of Americans, particularly with no legal sanction, the end of the day, individuals should make educated options about their own healthcare. They shouldn’t be pushed into getting a jab in this circumstance.

“Ultimately, people need to be able to make these decisions,” the governor included, alerting that the OSHA mandate is simply the “tip of the iceberg”:

I don’t believe individuals want this choice tugged far from them. I don’t believe they wish to enable a precedent where the federal government could be available in and just require you to do what it wants you to do and make no mistake about it, those individuals who have gone through a regular vaccination series for COVID– you will be figured out to be unvaccinated soon. They will do that. They are going to tell you you’re unvaccinated and you need to get a booster. Otherwise you could possibly deal with loss of work or other kinds of charges. So that is going to happen. They’re not putting that in the rule, but they’re currently requesting for feedback on how to do this going forward. So this is just the pointer of the iceberg. It’s going to get more restrictive.

“There’s going to be more power brought to bear, moving forward if we don’t stand now, and resist. I simply believe individuals are so sick of continuously being bossed around limited, mandated all these different things,” he continued.

“We have actually had enough of it, and we desire individuals to be able to make their own choices. So it is essential to defend people’s private ability to make decisions for themselves,” the governor included.

OSHA released the guideline on Thursday, which imposes vaccine and testing requirements on personal organizations with over 100 employees. Especially, the guideline, which enters into result January 4, positions what amounts to a “work tax” on unvaccinated employees, as OSHA “does not require employers to pay for any expenses connected with screening.”
